Settlement Agreement FAQs

What is the purpose of a settlement agreement?

Sometimes in a redundancy or dismissal situation or in settling a grievance, an employer may ask the employee to sign a Settlement Agreement.  This is an agreement by which you may settle, waive or compromise any claims you may have against your employer/former employer. It is therefore vitally important that you take legal advice before signing any settlement agreement.

What paperwork will you need?

We will need to see the settlement agreement and if you have it, your contract of employment.

We will also need some ID documentation, which we can discuss on the phone with you.

Do I Need Legal Advice?

The law relating to Settlement Agreements requires that you seek independent professional legal advice.

Once you sign the agreement, that concludes all future claims against the employer and therefore it’s important to understand your legal rights and to discuss your circumstances.

Can I still Get A Reference?

Whilst there is no obligation for the employer to provide one, it is usually possible to arrange one. We can ask them to stipulate this in the agreement and we may even be able to help you negotiate the specific wording of your reference.

What our clients say

“I’d like to thank you all very much for the thoroughly professional way in which you dealt with my case. Being forced out of a job is a thoroughly distressing experience and, whilst I felt that as a matter of principle I had to take action, I have to say I was dreading it. However, your calm, orderly approach, clear instructions, and practical kindness made it much less of an ordeal than I had expected.  I am delighted to have won the moral victory.”

Client

“Laura Thorpe was excellent in all aspects of our required legal representation. She always had time to discuss and explain the situation and made a concerning situation much easier to deal with. I would also like to thank all at PM Law for the professionalism and would certainly recommend their services to anyone in a similar situation to that which I found myself.”
